Trump's former lawyer steps down in the wake of court rules against her appointment.
Alina Habba has stepped down as the chief federal prosecutor in the state. This follows a legal ruling that challenged her right to hold the office.
Attorney General's Statement
The head of the Justice Department, the Attorney General, accepted her stepping down on Monday. In a statement that the court's "flawed" ruling made it unworkable for Habba to perform her duties.
"Let no one confuse compliance for surrender," she wrote. "My fight will now stretch across the country."
Legal Background
Her resignation follows closely on a judicial panel ruled that she had been unlawfully serving as US attorney. This decision is likely to affect scores of criminal cases in the Garden State.
The appellate judges declared that a temporary posting that bypassed Senate approval breached the Federal Vacancies Reform Act.
Ongoing Legal Battle
It was also stated that Habba will continue working within the DOJ as a top consultant. Habba plans to seek further review of the ruling, aiming for a overturned decision.
On a social media platform, the Attorney General contended that the court "must not countermand the President's choice of lawyers tasked with carrying out the fundamental role of the presidency of enforcing the law."
Record and Legacy
The attorney general highlighted Habba's record and said that during her run, the state capital of Newark saw a significant drop in offenses. She also stated that the city of Camden recorded its initial homicide-free summer since 1974 free from homicides.
Legal Career
The 41-year-old attorney, first joined the former president's legal defense in recent years. She went on to represented Trump in his business records case in New York last year, which resulted in his conviction on multiple felony counts of financial record manipulation.
Prior to her appointment to the federal prosecutor position, Trump had stated he was appointing her as his presidential counsellor during his second administration, calling her as deeply loyal and a dedicated fighter for justice.
